Terms of Service

Terms of Service — Dylan Phillips Photography Client Gallery

By accessing, downloading, or purchasing any images or products within this gallery, you agree to the following terms:

1. Copyright

All images are the exclusive intellectual property of Dylan Phillips Photography and are protected under Canadian copyright law.

Images are not transferred into your ownership. You receive a usage licence only.

2. Personal Use License (Portraits, Family, Weddings, Lifestyle Clients)

Unless otherwise stated, delivered images include a personal use license, which allows you to:

  • Download and store images for personal use

  • Share on social media with credit (@dylanphillipsphotography)

  • Print for personal display or gifts

You may not:

  • Sell the images

  • Use images for advertising, business promotion, or commercial purposes without a commercial licence

  • Alter images with heavy filters or edits that misrepresent the original work

3. Wrestling Galleries (Event Photography)

Wrestlers and promotions may download reduced-resolution images for social media posting with visible credit.

You may not:

  • Sell images as merchandise (8×10 prints, posters, trading cards, etc.) without a Licensing Agreement

  • Provide images to other promotions for advertising without permission

    VIPW has extended usage rights as the hiring entity.

4. Commercial and Branding Clients

Commercial or promotional use (including websites, digital ads, print marketing, product promotion, or paid social campaigns) requires a separate commercial licensing agreement, unless explicitly stated in writing.

5. File Delivery and Gallery Access

  • Galleries are delivered digitally via Pixieset.

  • Access is granted to the client and any person they share the link with.

  • Dylan Phillips Photography is not responsible for unauthorized sharing.

  • Galleries may be archived or removed after a reasonable period; please download your files promptly.

6. Image Quality & Edits

  • Final delivered images represent the photographer’s artistic style.

  • RAW files are never provided.

  • Requests for additional retouching may require an extra fee.

7. Refunds and Payments

Due to the digital nature of photography services, all sales are final.

Retainers/booking fees are non-refundable.

8. Prints and Products

  • All prints and products are fulfilled through approved labs or local print partners.

  • Colors may vary slightly depending on screen calibration or print process—this is normal.

9. Liability

While every reasonable effort is made to preserve and secure your images, Dylan Phillips Photography is not liable for:

  • Loss or damage caused by system failures, acts of nature, or hosting platform issues

  • Third-party printing errors
